1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your use of the Uncloud mobile application (“the App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
These Terms are governed by the laws of the jurisdiction in which you reside.
2. About the App
Uncloud is a wellness companion designed to support your vaping cessation journey. It provides personalised quit plans, craving management tools, progress tracking, and recovery milestones.
Uncloud is not a medical device. Nothing in the App constitutes medical advice, diagnosis, or treatment. Please refer to our Medical Disclaimer for full details.
3. Eligibility
You must be at least 18 years of age to use the App. By using the App, you confirm that you meet this age requirement.
4. User Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes, subject to these Terms.
All intellectual property rights in the App, including its design, content, code, and branding, remain the property of Uncloud. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
5. User Responsibilities
You are responsible for:
- The accuracy of any data you enter into the App.
- Seeking professional medical advice for any health concerns. The App is not a substitute for qualified healthcare guidance.
- Maintaining the security of your device and any backups you create.
6. In-App Purchases
Uncloud offers a one-time “Pro” upgrade that unlocks additional features. This purchase is processed through the Apple App Store or Google Play Store via our payment processor, RevenueCat.
Refund policies are governed by the respective app store’s terms. Your statutory consumer rights are not affected by these Terms.
7. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we handle your data. All personal data is stored locally on your device. We do not collect, transmit, or store your data on any server.
8. Third-Party Services
The App integrates with the following third-party services:
- RevenueCat — processes in-app purchase transactions.
- Apple App Store / Google Play Store — distributes the App and processes payments.
- Apple iCloud — optional cloud sync, if enabled by you.
We are not responsible for the terms, policies, or practices of these third-party services. We encourage you to review their respective terms and privacy policies.
9. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the health information in the App is complete, current, or applicable to your individual circumstances. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be unlawful to exclude or limit liability.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Uncloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
Nothing in these Terms affects your statutory rights as a consumer under applicable law.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised accordingly. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms. Upon termination, your licence to use the App is revoked. As all data is stored locally on your device, termination does not affect data you have already saved.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which you reside. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the courts in your place of residence.
